US resists disclosures in ‘Cuban Five’ spy case
MIAMI — The U.S. is resisting a judge’s order that could force disclosure of classified material in the case of three Cuban men convicted of spying.
The order requires the U.S. to turn over any national security damage assessments in the so-called Cuban Five case. Three of the men are to be resentenced Oct. 13 in Miami after an appeals court vacated their original sentences.
The U.S. is appealing, contending the order would require prosecutors to produce classified material and cause delay. Attorneys for the three Cubans want any documents that might show their actions didn’t jeopardize national security. That would bolster their argument for a lenient sentence.
U.S. officials say no damage assessments have been found.
